Rental Agreement

Please note that the Rental Agreement has been updated, 7/13/2024. If you've rented the property previously, please reread the Rental Agreement for information/rules that may be different from your last visit.

1. The Parties
This agreement is made between EBGR Ownership (referred to hereafter as ownership or landlord) and the tenant as tenant has selected in the reservation feature on emptybarguestranch.com, including days property is to be rented, number of adult guests, children and pets. Tenant is named as person who signs this form (at the bottom) by submitting e-signature and monies relating to this rental period. Tenant's guests, children and pets may also be noted as tenant's party hereafter.

3. Period and Guests
Total people in renting party consists of the selections made by tenant in the reservation feature on emptybarguestranch.com, not to exceed 10 people at any time on premises, and 2 animals (dogs or cats only). Tenant is held accountable, by means below noted, that the guest information (number of, and types) are accurate and true.

Rental period begins at 2 PM on the date of reservation and extends until 10 AM day of check out as outlined by reservation feature on emptybarguestranch.com.

4. Rental Amount
Total rental amount for the period is as selected on reservation feature on emptybarguestranch.com.

5. Fees, Taxes, and Deposit

Cleaning Fee: Is as outlined in the reservation feature when reservation is made.

Security Deposit: Is as outlined in the reservation feature when reservation is made.

Pet Fee: $130 per reservation

6. Termination
Empty Bar Guest Ranch (ownership) has the right to inspect the premises without prior notice as stated with the applicable state laws (Montana). Should the tenant violate any of the terms of this agreement, the rental period shall be terminated immediately in accordance with state law. The tenants waive all rights to process if they fail to vacate the premises upon termination of the rental period. The tenants shall vacate the premises at the expiration time and date of this agreement.

7. Phone Calls
Please note that there is no included long distance calling available; tenants will need to provide a pre-paid phone/calling card should they wish to make any long distance calls.

8. Maintenance and Repairs
The Tenant shall maintain the premises in a good, clean, and ready to rent condition (less basic housekeeping as outlined in Cleaning Fee), and use the premises only in a careful and lawful manner. The tenant shall leave the premises in a ready to rent condition at the expiration of the rental agreement, defined by the EBGR-Owners as being immediately habitable by the next tenants (less basic housekeeping as outlined in Cleaning Fee). Tenants shall pay for maintenance and repairs should the premises be left in a lesser condition. The tenant agrees that the EBGR Owner shall deduct costs of noted cleaning services from the security deposit prior to refund if tenants cause damage to the premises or its furnishings. A Lost or Missing Key Fee will be charged at the owner's discretion if Tenant fails to leave keys in the Key Drop Box, for whatever reason, causing new keys to be made.

9. Trash
The Tenant shall dispose of all waste material generated during the rental period in the outdoor bear proof container/dumpster provided on site. Any trash not properly disposed of in the aforementioned manner will be subject to extra cleaning fees and/or maintenance and repairs outlined in this agreement. A fee at the owner's discretion shall be instated if dirty dishes are left anywhere on the property.

10. Pets Policy
A maximum of 2 pets are permitted, cats and/or dogs during the rental time at a cost of $130 per reservation. Pets are not permitted on beds or furniture. It is required that pet messes and pet waste is picked up/wiped up and disposed of properly.

11. Subletting
The Tenant shall not have the right to sublet the property.

12. Quiet Enjoyment
The Tenant(s) including children and pets shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding property owners. The Tenants shall not create noise or disturbances likely to disturb or annoy the surrounding property owners. Creating a disturbance of the above nature shall be grounds for immediate termination of this agreement and tenant and full party shall then immediately vacate the premises.

13. Smoking
There is to be no smoking indoors in any building.
14. Landlord’s Liability
The tenants and party shall hereby indemnify and hold harmless the EBGR Ownership against any and all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss. Tenant and party expressly recognizes that any insurance for property damage or loss which the ownership may maintain on the property does not cover the personal property of tenant and party and that tenant should purchase their own insurance for tenants and party, and other guests if such coverage is desired.

15. Security Deposit and Cancellation
If you cancel 45 days or more prior to the first day of your reservation, you will receive a full refund, minus an Administration fee (up to $350.00.) Any cancellations made after the 45 day mark will result in forfeiture of the nightly rental fee for the duration of your reservation. You will be refunded the entirety of the Security Deposit and Cleaning Fee. The security deposit will be held at EBGR ownership's discretion due to damages etc. as outlined here and in other sections of this agreement.

16. Attorney’s Fees
Tenant agrees to pay all reasonable costs, attorney's fees and expenses that shall be made or incurred by EBGR Ownership enforcing this agreement.

17. Use of Property & Privacy Disclaimer
Tenants expressly acknowledge and agree that this agreement is for transient occupancy of the property, and that tenant and party do not intend to make the property a residence or household. Parties and events are not permitted use of the property and will result in extra charges, eviction or both at EBGR Ownership's discretion. No more than 10 people should be on the premises at any time and 2 pets. Privacy Disclaimer: EBGR property management utilizes 24 hour security surveillance (via live and recorded camera feed) on the exterior only of buildings.

18. Cleaning Policy
Cabins should be tidy, larger messes shall be cleaned as needed during tenant's stay. Used towels shall be in hampers. No need to strip bed(s). Dishes shall be clean and put away. Messes and dirty dishes are subject to a fee of the owner's discretion if messes have harmed property and require labor, repair or replacement; this is at ownership's discretion.

19. Shortened Stays and Conditions
There shall be no refunds of rents due to shortened stays or ruined expectations because of weather conditions.

20. Firearms
Only legally owned and permitted firearms shall be allowed on the premises according to state and local laws.

21. Fireworks
Tenant agrees that fireworks and other hazardous materials shall not be used in or around the property. There shall be no open burning during times of wind.

22. Illegal Use
Tenant shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person or animal, harboring fugitives, etc. shall cause termination of this agreement with no refund of rents or deposits, with legal expenses and all damages at the tenant's own cost.

23. Fire Alarms
If the property has fire alarms the tenant must notify the landlord without delay if a fire alarm “chirps” or has a low battery condition. Fire safety items shall not be tampered with. Extinguishers are to be used only in case of fire that would reasonably require its detonation and use.

24. Possessions
Valuable items left behind by tenant will be held for the tenant and every reasonable effort will be made to contact the tenant for return. If items are not claimed for longer than 6 months they shall become the permanent property of the EBGR Ownership. The EBGR Ownership shall not be held liable for condition of said items during the time after guest has vacated and before the item is returned to tenant.
25. Cable TV
Cable TV is provided and service level has been chosen by EBGR Ownership. No refund of rents shall be given for outages, content, lack of content, or personal preferences with regard to cable TV service.
26. Internet
Internet is provided as a complimentary feature only and is not integral to the agreement. No refund of rents shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to internet service.

28. Governing Law
This agreement is governed under the laws of Montana.
​
29. Right to Refuse Reservation/Service
EBGR (Owner) reserves the right to refuse a reservation. If reservation is not verified, the full price of rental, security deposit and cleaning fee will be refunded.

30. Rental Confirmation
Within 5 days after booking, Tenant will receive confirmation email in regards to their reservation.
EBGR Ownership and Tenant agree to the above conditions on this day the Rental Agreement is signed and submitted below by filling out the form and completing financial transaction within Reservation feature on emptybarguestranch.com. By submitting the information below, you hereby swear that the information provided is accurate and true:
